Privacy policy

AMJ Software Labs Limited respects your privacy. This policy explains what personal information we collect through this website and in our work, why we collect it and how we look after it. We follow the New Zealand Privacy Act 2020 and, where they apply to us, the Australian Privacy Act 1988 and the EU General Data Protection Regulation (GDPR).

Who we are

This website is run by AMJ Software Labs Limited (“AMJ”, “we”, “us”), a software development company with its head office at 18A Roseberry Avenue, Birkenhead, Auckland 0626, New Zealand. We are responsible for the personal information described in this policy (under the GDPR, we are the “controller”).

What we collect

  • When you send an enquiry: your name, email address, and, if you provide them, your company, phone number, the services you’re interested in and your message. We also record the date, time and IP address of the submission to protect the form against spam and abuse.
  • When you email or call us: the details you choose to share.
  • When you work with us: business contact details, project information and the invoicing details we need to deliver our services.
  • When you browse this website: aggregated statistics from Ahrefs Web Analytics, such as the pages viewed, the referring website, approximate country and device and browser type. It does not use cookies and does not identify you.
  • Server logs: our hosting provider automatically records technical information such as IP address, date and time, the page requested, browser type and referring page, to keep the website secure and running.

Please don’t send us sensitive information (such as health details) through the contact form.

How we use it, and our legal basis

  • To reply to your enquiry and prepare a proposal. This is a step you asked for before a possible contract, and in our legitimate interest in responding to people who contact us (GDPR Art. 6(1)(b) and (f)).
  • To deliver our services and manage our relationship with clients (performance of a contract, Art. 6(1)(b)).
  • To protect the website and contact form against spam, abuse and attacks (legitimate interests, Art. 6(1)(f)).
  • To understand, in aggregate, how the website is used so we can improve it (legitimate interests, Art. 6(1)(f)).
  • To meet legal obligations such as tax and accounting record-keeping (legal obligation, Art. 6(1)(c)).

We don’t sell or rent personal information, we don’t use it for automated decision-making or profiling, and we won’t add you to a mailing list without your consent.

Who we share it with

We share personal information only with organisations that help us run our business, and only as far as they need it:

  • Hostinger International Ltd, which hosts this website and our business email.
  • Ahrefs Pte. Ltd. (Singapore), which provides our cookie-free website analytics.
  • Professional advisers, such as our accountants and lawyers, and public authorities when the law requires it.

These providers may only use the information to provide their services to us and must keep it secure.

International transfers

We are based in New Zealand, which the European Commission recognises as providing an adequate level of data protection for personal information transferred from the EU. Our service providers may process information in other countries. Where personal information is transferred outside New Zealand, Australia or the EU/EEA, we rely on safeguards the law recognises, such as adequacy decisions or standard contractual clauses, and take reasonable steps to make sure it stays protected.

How long we keep it

  • Enquiries that don’t lead to a project: up to two years, then deleted.
  • Client and project records: for as long as we work together and afterwards for as long as the law requires. For example, New Zealand tax law requires business records to be kept for seven years.
  • Spam-protection markers: the contact form stores a one-way hash of your IP address to limit repeat submissions. These markers are deleted within two days.
  • Server logs: kept by our hosting provider for a limited period for security purposes.

How we protect it

All traffic to this website is encrypted with HTTPS. The contact form checks and filters what it receives, limits repeat submissions and delivers enquiries straight to our business mailbox. They are not stored in a website database. Access to our mailboxes and systems is restricted and password-protected. You can read more on our security page.

Cookies

This website doesn’t set cookies and doesn’t use advertising or tracking cookies, which is why you won’t see a cookie banner. Our analytics tool, Ahrefs Web Analytics, works without cookies. If we ever add tools that use cookies or similar technology, we will update this policy and ask for your consent where the law requires it.

Your rights

You can ask us for a copy of the personal information we hold about you, and ask us to correct it (New Zealand Privacy Act, Information Privacy Principles 6 and 7; Australian Privacy Principles 12 and 13).

If the GDPR applies, you also have the right to have your information erased, to restrict or object to how we use it (including processing based on our legitimate interests), to receive it in a portable format, and to withdraw consent at any time where we rely on consent.

To use any of these rights, email info@amj-tech.co.nz. It’s free. We may need to confirm your identity first, and we will reply within 20 working days (one month under the GDPR).

Complaints

If you’re unhappy with how we’ve handled your information, please tell us first so we can put it right. You can also complain to a regulator:

  • New Zealand: the Office of the Privacy Commissioner, privacy.org.nz
  • Australia: the Office of the Australian Information Commissioner, oaic.gov.au
  • European Union: the data protection authority where you live or work.

Other websites

This website links to other sites, such as our clients’ websites, app stores and Google Maps for our office addresses. Those sites have their own privacy policies, and we’re not responsible for how they handle your information.

Children

Our website and services are intended for businesses and are not directed at children under 16.

Changes to this policy

We may update this policy from time to time. The date at the top of the page shows when it last changed.
